I see, well that is an entirely different perspective. Well the 2 stars at the end of their advertisement indicate one or more conditions that will have to be met prior...it is much too late to go back and determine what those were and I am not convinced it would help your cause.
I would suggest making a call to Dell Sales and describing your set of circumstances, make a request early in your conversation to speak directly with someone who will have the authority to make a decision and document whom you spoke with. One key to your success will be to maintain your composure and be polite, you are trying to win the support of the person you are speaking to, and they do have some capacity to limit your ability to locate someone who can help. Also, remembering that negotiation is an art. For example, "kicking in the door and demanding to speak to the commander only works in the movies", so mentally prepare to overcome the gatekeeper and be persistent.
This may get you the result you are looking for, or maybe compensated via a credit that can be applied to a next purchase or complimentary software you would like to have but couldn't justify at the time. Do get a supervisor and/or auditor on the line with the rep to oversee the conversation...document, document, document.
In the end you may find it more productive to have just reg. your system for the upgrade and placed your order, it looks like it takes approx. 10 days to see your service tag show up in the system, then once you place the order, allow 1-2 weeks to receive your shipment. Some of the delay may be the process itself, the 4 week turn around appears to be a default in their system, it souldn't take that long.
It's the principle of it all, I am sure you feel Dell owes it to you to keep their end of the deal, you are correct. It is consumer preference that drives their business...good news travel fast, bad news even faster! (my guess is they are aware of the issues)
